Support Your Water Right Claim
In Montana there are a number of ways to acquire a right to use the waters of the State. Paramount among those paths to a water “right” is the water right “claim” process. That process deals exclusively with water that is “claimed” to have been first put to Beneficial Use before July 1, 1973, and remains in that use today.
Among the many water-related services we offer, the following services are specifically focused to help water right “claim” holders as they prepare to defend and protect their historic right-to-water the “claim” moves through the current Court Adjudication re-evaluation process:
- Consultation overviews to help “claim” holders understand the Adjudication of “claims” process for obtaining a durable and enforceable water “right”.
- Professional assessments of the strengths and weaknesses of a particular “claim” as it enters the Adjudication Process
- Research reports to document and support the historic validity, viability, completeness and reasonableness of a particular “claim”
- Assistance in addressing, and overcoming concerns, DNRC Issue Remarks and respond to formal Objections to a specific “claim”
- Preparation of forms required by DNRC or by the Water Court
